State Summary
In 1994 California banned smoking in all workplaces, including restaurants. This ban was then extended in 1998 to include bars. Smoking is also prohibited within 20 feet of any door, window or air intake of a government owned or leased building, including public universities. While the law covers all enclosed workspaces, no statewide ban exists for smoking in outdoor dining facilities or patios and is regulated by local governments.

SECTION 1. Section 6404.5
(1) Posted clear and prominent signs, as follows:
(A) Where smoking is prohibited throughout the building or structure, a sign stating "No smoking" shall be posted at each entrance to the building or structure.
(B) Where smoking is permitted in designated areas of the building or structure, a sign stating "Smoking is prohibited except in designated areas" shall be posted at each entrance to the building or structure.
