Additional efforts on the part of the employer become even more necessary when little slips in behavior create legal hassles, tarnish professional relations, and in extreme cases, become life threatening.<\/p>\n<p>In a <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2013\/dec\/13\/office-holiday-parties-sexual-harassment\">survey <\/a>conducted by&nbsp;Adecco HR firm, &nbsp;a surprising 11&nbsp;percent&nbsp;of respondents revealed they lost their job or knew someone who did, due to embarrassing behavior at an office holiday party, while 40 percent of respondents knew someone who behaved badly and 23 percent agreed to receive an official warning for inappropriate behavior at office parties.<\/p>\n<p>Although the law varies from state to state, office-sponsored parties are generally considered a workplace activity, bringing employers in the legal orbit. One such example is the <a href=\"https:\/\/www.law360.com\/articles\/472718\/marriott-case-could-curb-alcohol-at-company-parties\" target=\"_blank\" rel=\"noopener noreferrer\">Purton vs. Marriott case<\/a>. A Marriott employee killed a man in a car crash after he was intoxicated from the alcohol he consumed at his employer\u2019s party. The appellate court held Marriott responsible for the accident, citing that the proximate cause of the accident occurred within the scope of the employer.<\/p>\n<div id=\"attachment_2616\" style=\"width: 355px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.mydoorsign.com/blog\/wp-content\/uploads\/2014\/12\/8371181143_d6c7c173c2_z.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-2616\" class=\"wp-image-2616\" src=\"https:\/\/www.mydoorsign.com/blog\/wp-content\/uploads\/2014\/12\/8371181143_d6c7c173c2_z-300x276.jpg\" alt=\"Employees overindulging in an office parties should not go unnoticed.\" width=\"345\" height=\"318\"><\/a><p id=\"caption-attachment-2616\" class=\"wp-caption-text\">Employers must be wary of potential legal liabilities while organizing office holiday parties. From&nbsp;<a href=\"https:\/\/www.flickr.com\/\">gazeronly<\/a>.<\/p><\/div>\n<p>Considering that an&nbsp;employer&#8217;s liability is not restricted to the office premises, the National Federation of Independent Business (NFIB) called on small businesses to be aware of&nbsp; incidences of harassment and drunk driving following holiday parties. NFIB&nbsp;also advised companies to remind employees that the holiday office party is a work-related activity where everyone is expected to behave appropriately.<\/p>\n<p>Alcohol-related traffic crashes rise during the holidays. According to the National Highway Traffic Safety administration (<a href=\"https:\/\/cdn0.vox-cdn.com\/uploads\/chorus_asset\/file\/2493152\/HOLIDAY_NATIONAL_2012_2_.0.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">NHTSA<\/a>), in 2012, 37 to 44&nbsp;percent of&nbsp;traffic accidents during the holiday&nbsp;season involved alcohol.<\/p>\n<p>To&nbsp;stay safe from the legal liabilities that could arise from employee behavior, employers should plan the office holiday party meticulously. Businesses can arrange for cabs to <a href=\"https:\/\/www.nydailynews.com\/2014\/12\/08\/app-sends-designated-driver-to-get-partygoers-and-their-cars-home-safely\/\" target=\"_blank\" rel=\"noopener noreferrer\">take employees home<\/a>. A designated driver service app like BeMyDD can even be used to drive employees to their home using their own car, thus saving the headache of retrieving it the next morning.<\/p>\n<p>One of the most recommended ways to avoid workers indulging in excessive drinking or other misconduct is to invite spouses or partners who can help put a cap on unwarranted behavior.
