{"id":1410,"date":"2017-03-18T09:40:15","date_gmt":"2017-03-18T09:40:15","guid":{"rendered":"https:\/\/www.mydoorsign.com\/blog\/?p=1410"},"modified":"2026-02-27T00:46:17","modified_gmt":"2026-02-27T05:46:17","slug":"gender-neutral-restroom-debate","status":"publish","type":"post","link":"https:\/\/www.mydoorsign.com/blog\/gender-neutral-restroom-debate\/","title":{"rendered":"The gender-neutral restroom debate: right or privilege?"},"content":{"rendered":"<p>Earlier this month, the vote to pass the Employment Non-Discrimination Act marked the first time in history a transgender employment non-discrimination bill passed in the Senate. The bill\u2019s approval is a huge step toward equality for gay, lesbian, bisexual, transgender, and questioning workers. The question that needs to be asked going forward is: How will employers adjust to support LGBTQ individuals?<\/p>\n<p>Those outside the LGBTQ community may not be familiar with the discrimination these employees face. A study conducted by the Williams Institute at the University of California Los Angeles School of Law provided detailed examples of harassment of LGBTQ employees in the workplace and 90% of transgender respondents reported experiencing mistreatment at work. Unfortunately, only 15 percent of those who reported discrimination filed a complaint out of fear of \u201couting\u201d themselves further.<\/p>\n<p><a href=\"https:\/\/www.smartsign.com\/all-gender-restroom-signs\">Gender-neutral restrooms<\/a>\u00a0are one method to assure LGBTQ employees they are welcome and equal in the workplace. Gender-neutral restrooms are restrooms anyone can use. While most people take comfortable access to restrooms for granted, transgender people may face confrontation over which bathroom they should use. Restrooms should serve as a safe place for <em>all<\/em> employees.<\/p>\n<div id=\"attachment_1412\" style=\"width: 370px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.mydoorsign.com/blog\/wp-content\/uploads\/2013\/11\/allgender.gif\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-1412\" class=\" wp-image-1412 \" src=\"https:\/\/www.mydoorsign.com/blog\/wp-content\/uploads\/2013\/11\/allgender.gif\" alt=\"gender-neutral\" width=\"360\" height=\"360\" \/><\/a><p id=\"caption-attachment-1412\" class=\"wp-caption-text\">Signs available at <a href=\"https:\/\/www.mydoorsign.com\/california-wall-door-all-gender-restroom-sign-kit\/sku-se-6071\">MyDoorSign<\/a>.<\/p><\/div>\n<p>The Office of Personnel Management, a federal agency that enforces civil service laws, set the following guidelines: \u201cOnce (a transgender employee) has begun living and working full-time in the gender that reflects his or her identity, agencies should allow access to restrooms\u2026consistent with his or her gender identity.\u201d<\/p>\n<p>Bathroom safety can be a concern for transgender people because it\u2019s a private place where they might not be able to seek help if a conflict arises. Seven to 41 percent of LGBTQ workers were verbally or physically abused at work. All-gender bathrooms may serve as a solution to such workplace conflict.<\/p>\n<p>Recently, the popular comedy news program <i>The Colbert Report <\/i><a href=\"https:\/\/www.paramountplus.com\/intl\/#ftag=PPM-18-10caf1d\" target=\"\u201d_blank\u201d\" rel=\"noopener noreferrer\">discussed<\/a> our All-Gender bathroom <a href=\"https:\/\/www.mydoorsign.com/blog\/colbert-report-gender-restroom-signs\/\">signs<\/a>. Stephen Colbert quoted the Family Research Council, a conservative Christian group, as saying that \u201c\u2026restrooms and locker rooms could become landmines for disputes and disturbances. An anatomically male employee who claims a female gender identity might be able to demand access to the women\u2019s restroom.\u201d<\/p>\n<div id=\"attachment_1413\" style=\"width: 444px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.mydoorsign.com/blog\/wp-content\/uploads\/2013\/11\/colbert1.png\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-1413\" class=\" wp-image-1413 \" src=\"https:\/\/www.mydoorsign.com/blog\/wp-content\/uploads\/2013\/11\/colbert1.png\" alt=\"gender-neutral\" width=\"434\" height=\"361\" srcset=\"https:\/\/www.mydoorsign.com/blog\/wp-content\/uploads\/2013\/11\/colbert1.png 595w, https:\/\/www.mydoorsign.com/blog\/wp-content\/uploads\/2013\/11\/colbert1-300x250.png 300w\" sizes=\"auto, (max-width: 434px) 100vw, 434px\" \/><\/a><p id=\"caption-attachment-1413\" class=\"wp-caption-text\">MyDoorSign&#8217;s <a href=\"https:\/\/www.mydoorsign.com\/all-gender-handicap-restroom-braille-toilet-symbol-sign\/sku-se-6059\">All Gender Restroom Sign<\/a> on <a href=\"https:\/\/www.paramountplus.com\/intl\/#ftag=PPM-18-10caf1d\" target=\"\u201d_blank\u201d\" rel=\"noopener noreferrer\">The Colbert Report<\/a>.<\/p><\/div>\n<p>Mildred Ramos, Deputy Executive Director of Operations at the Ali Forney Center disagrees, saying \u201cWe strongly feel that creating gender-neutral signs\/restrooms helps our community better acknowledge and accept diverse gender expressions. Similarly, we feel that gender normative approaches, such as male and female gender signs, can create serious conflicts for those who are struggling with their gender expression.\u201d The Ali Forney Center places New York City\u2019s homeless LGBTQ youth in safe, homelike environments.<\/p>\n<p>In October, Philadelphia passed a <a href=\"https:\/\/www.mydoorsign.com/blog\/philadelphia-gender-neutral-restrooms-law\/\">new law<\/a> requiring all new, city-owned buildings to be equipped with gender-neutral restrooms. The mandate also made Philadelphia the first U.S. city to provide tax credits to businesses that offer LGBT-inclusive benefits. As the bill\u2019s sponsor, Councilman Jim Kenney, explained, \u201cIt can be an awkward and embarrassing situation (for those who) feel more like a woman, but can\u2019t use the women\u2019s room.\u201d Elsewhere, gender-neutral restrooms remain an option some favor, while others remain strongly in opposition.<\/p>\n<p>The gender-neutral bathroom debate also challenges organizations\u2019 intentions: are they after political correctness or good public-relations karma? <i>The Rocket<\/i>, student newspaper of Slippery Rock University in Slippery Rock, PA, recently published an opinion <a href=\"https:\/\/www.theonlinerocket.com\/opinion\/2013\/11\/21\/new-transgener-bathrooms-a-publicity-stunt-by-sru\/\" target=\"\u201d_blank\u201d\" rel=\"noopener noreferrer\">column<\/a> in which the writer argued that designating a restroom as gender neutral is simply a publicity stunt. According to the column, \u201cIt\u2019s something that was likely sent to everybody in a \u201cGood News\u201d email from the PR department.\u201d Even if that\u2019s true, gender-neutral bathrooms are becoming a reality and benefitting LGBTQ people.<\/p>\n<div id=\"attachment_1415\" style=\"width: 352px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/www.mydoorsign.com/blog\/wp-content\/uploads\/2013\/11\/gnr.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-1415\" class=\" wp-image-1415 \" src=\"https:\/\/www.mydoorsign.com/blog\/wp-content\/uploads\/2013\/11\/gnr.jpg\" alt=\"gender-neutral\" width=\"342\" height=\"342\" srcset=\"https:\/\/www.mydoorsign.com/blog\/wp-content\/uploads\/2013\/11\/gnr.jpg 612w, https:\/\/www.mydoorsign.com/blog\/wp-content\/uploads\/2013\/11\/gnr-150x150.jpg 150w, https:\/\/www.mydoorsign.com/blog\/wp-content\/uploads\/2013\/11\/gnr-300x300.jpg 300w\" sizes=\"auto, (max-width: 342px) 100vw, 342px\" \/><\/a><p id=\"caption-attachment-1415\" class=\"wp-caption-text\">via <a href=\"https:\/\/www.flickr.com\/photos\/36521954815@N01\/8571936397\/in\/photolist-e4tq3R-dZgr6D\" target=\"\u201d_blank\u201d\" rel=\"noopener noreferrer\">Bryan Alexander<\/a><\/p><\/div>\n<p>Dr. Jillian T. Weiss, professor of Law and Society at Ramapo College of New Jersey, does not see gender-neutral bathrooms as a necessity, but appreciates their significance. \u201cSection 8(b) of the (Employment Non-Discrimination Act) specifically states that new construction is not required. However, workplaces \u2026 which have a transgender population, may wish to designate such a bathroom,&#8221; she told us. &#8220;Bathrooms that are single-use facilities may easily be designated as gender neutral. These would give comfort to transgender employees or potential employees who have concerns about using a single sex facility.\u201d<\/p>\n<p>Opponents have plenty of arguments as to why all gender bathrooms are unnecessary: gender-neutral bathrooms are a so-called \u201cspecial privilege\u201d for transgender people; men and women shouldn&#8217;t be forced to share a bathroom; it makes some people uncomfortable; it\u2019s too expensive, there\u2019s not enough space; and so on. Every argument has a rebuttal, but the bottom line is, each employer decides what\u2019s right for their business (unless you work in Philadelphia in a city-owned building).<\/p>\n<p>So, while gender-neutral bathrooms are not a requirement, adding a third option takes nothing away from those who prefer to use the men\u2019s or women\u2019s restroom, but can make a world of difference for those who want to avoid questions about their choice of gendered bathroom.
